Contracts Built for Health Tech SaaS

Selling software into healthcare brings legal and contracting considerations that don't exist in a typical SaaS relationship.

Depending on your product, customers and data practices, your contracts may need to address protected health information, HIPAA requirements, security obligations, breach responsibilities and business associate relationships - while still covering the commercial terms that govern your SaaS product.

Meyer Law's Health Tech SaaS Agreement Package gives you a customized SaaS customer agreement and Business Associate Agreement (BAA) designed around your technology, business model and healthcare customers.

Who This Package Is For

This package is designed for health tech companies that:

  • Offer a SaaS or technology product to healthcare organizations

  • Create, receive, maintain or transmit PHI in connection with customer relationships
  • May act as a business associate under HIPAA
  • Need a BAA for applicable customer relationships

Frequently Asked Questions

Do I need a BAA?

It depends on your company's role and the information involved. A BAA is generally required when a covered entity or business associate engages another business associate to perform certain functions or services involving protected health information. We'll discuss your business and data practices to help determine the appropriate contractual structure.

How is this different from the standard SaaS Agreement Package?

Our standard SaaS Agreement Package is designed for general SaaS customer relationships. This package is specifically designed for health technology companies and includes additional healthcare and data considerations as well as a customized BAA.

Does purchasing this package make my company HIPAA compliant?

No. HIPAA compliance extends beyond contracts and can involve administrative, technical and physical safeguards, policies, procedures, risk assessments and other requirements. This package focuses on the contractual documents included in the scope.

Can I use these agreements with multiple customers?

The agreements are designed to serve as standard forms for your business. Individual customers may request changes, use their own forms or have requirements specific to their organization or transaction.

Does this include negotiating with hospitals or other customers?

No. The package includes preparation of your standard agreements and one round of revisions based on your feedback. Customer-specific contract negotiations can be handled separately.

Does this include a DPA, Privacy Notice or security documentation?

No. Depending on your product, customers and data practices, you may also need privacy documents, a DPA, security addendum or other documentation. Meyer Law can help determine what additional work is appropriate.

What if we aren't sure whether HIPAA applies to our product?

Let us know before purchasing. We can determine whether this package is appropriate or whether your situation requires a different or more extensive scope.

How long does it take?

Most packages are completed within 1–3 weeks after your consultation and receipt of the information we need.
