Should I purchase the Trademark Search + Application Package instead?
If you haven't conducted a comprehensive trademark clearance search, we generally recommend considering the Trademark Search + Application Package.
A search can help identify potentially conflicting marks and allow you to evaluate risk before investing in a federal application. This Trademark Application Package does not include a comprehensive clearance search.
Does filing a trademark application guarantee registration?
No. Filing an application begins the USPTO review process. The USPTO may raise issues or refuse registration, and third parties may have rights or objections that affect an application.
Are USPTO filing fees included?
No. USPTO filing fees are paid separately. The amount depends in part on the number of classes and other aspects of the application.
How many trademarks does the package cover?
The package covers one federal trademark application for one mark.
If you want to protect both a name and a logo, for example, those would generally require separate applications.
Does the package include multiple trademark classes?
The package price includes attorney services for one application in one class. Additional classes require additional attorney fees and USPTO filing fees.
Can I file if I haven't started using the mark yet?
Depending on your circumstances, an intent-to-use application may be available. We'll discuss the appropriate filing basis during your consultation. Additional filings and fees may be required before registration.
Does this include responding to USPTO Office Actions?
Substantive Office Actions, oppositions, appeals and other post-filing proceedings are not included in the package price and will be separately scoped if they arise.
How long does Meyer Law take to file the application?
We generally prepare and file applications within 1–2 weeks after the consultation and receipt of the information we need.
The USPTO review and registration process takes substantially longer and timing can vary.
