Search Your Brand Before You File
You've invested time, money and energy into building your brand. Before investing even more, it makes sense to understand whether there are existing trademarks that could create problems for your proposed name or mark.
Meyer Law's Trademark Search + Application Package combines a comprehensive trademark clearance search with attorney guidance and preparation and filing of your federal trademark application.
We'll help you evaluate potential conflicts, understand the risks and make an informed decision before moving forward with your USPTO application.
Who This Package Is For
This package is a great fit if you're:
- Starting a new business or brand
- Launching a new product or service
- Preparing to invest significantly in a brand name
- Rebranding an existing business
- Ready to pursue federal trademark registration
- Unsure whether another company may have rights that conflict with your proposed mark
- Looking for attorney guidance before filing rather than filing first and discovering problems later
What's Included
Trademark Clearance Search
We'll conduct a search designed to identify potentially conflicting trademarks and other relevant uses of your proposed mark.
Depending on the mark and circumstances, our search may include:
- Federal trademark records
- State trademark records
- Relevant common-law uses
- Similar marks that may create potential conflicts
Attorney Review + 30-Minute Consultation
A Meyer Law attorney will review the search results with you, discuss potential conflicts and provide guidance regarding the risks and potential registrability of your proposed mark.
USPTO Application Preparation + Filing
If you decide to proceed, we'll prepare and file one federal trademark application with the U.S. Patent and Trademark Office for the mark covered by the package.
USPTO filing fees are separate and are not included in the package price.
How It Works
Step 1: Tell Us About Your Mark
After purchasing, we'll gather information about your proposed trademark, the products or services associated with it and how you are currently using or plan to use the mark.
Step 2: We Search + Analyze
Our team conducts the trademark search and evaluates potentially relevant results.
Step 3: Review With Your Attorney
We'll meet with you to discuss the search findings, potential risks and whether moving forward with an application makes sense.
Step 4: Prepare + File
If you decide to proceed, we'll prepare your application and file it with the USPTO.
Frequently Asked Questions
Does a trademark search guarantee my application will be approved?
No. A search helps identify potential conflicts and allows us to evaluate risk before filing, but it cannot guarantee that the USPTO will approve an application or that a third party will not challenge the mark.
What happens if the search identifies a potential conflict?
We'll discuss the results and your options. Depending on the circumstances, you may decide to proceed, modify your branding, consider another mark or conduct additional analysis.
What if I decide not to file after the search?
You are not required to proceed with an application. Part of the value of conducting the search first is having more information before investing further in a particular brand.
Does the package include the USPTO filing fee?
No. USPTO filing fees are paid separately and depend on the application and number of classes involved.
Does this package include more than one trademark class?
The package includes attorney services for one trademark application in one class. Additional classes will involve additional legal fees and USPTO filing fees.
Does this include responding to USPTO Office Actions?
No, responses to substantive USPTO Office Actions, oppositions, appeals and other post-filing proceedings are not included and will be separately scoped if they arise.
What if I'm not using the trademark yet?
You may still be able to file on an intent-to-use basis. We'll discuss the appropriate filing basis based on your circumstances. Additional USPTO filings and fees may be required before registration.
Can I protect multiple names or logos?
Each mark generally requires its own application. If you have multiple names, logos or brands to protect, Meyer Law can help you develop a filing strategy.
How long does Meyer Law's part take?
The search is typically completed within 3–5 business days after we receive the necessary information. If you decide to proceed, we generally prepare the application within 1–2 weeks.
The USPTO registration process itself takes considerably longer and is outside Meyer Law's control.
